TERMS AND CONDITIONS OF SALE

Preamble

Slow Village's main activity is the rental of leisure accommodation in its establishments in France. These General Terms and Conditions of Sale (GTCS) apply to all bookings made at our Inspire Villages properties operating under the Slow Village brand name. 

These conditions apply to all Slow Village establishments, which can be accessed via the website www.slow-village.com. The services offered by each establishment can be consulted online on their respective pages.

The relationship between the parties is governed exclusively by these terms and conditions and the village rules and regulations, available on our websites and displayed at the entrance to each establishment. Slow Village reserves the right to modify these terms and conditions at any time, and any new version will be published on our websites. The terms and conditions applicable are those in force on the date the reservation is validated. Photos on line have no contractual value. 

  1. Definitions

The terms and expressions hereinafter shall mean, when preceded by a capital letter, for the purposes of the interpretation and performance hereof: 

  • "Rental accommodation All types of accommodation (cabins, cottages, tiny houses, etc.) offered for rent;
  • "Campers Beneficiaries of campsite pitches other than those reserved for year-round rental;
  • "Pitches" pitches available for the installation of tents, caravans or motor homes by the customer;
  • "Order" request for Services made by the Customer to the Vendor;
  • "General Terms and Conditions of Sale" These are the general terms and conditions of sale;
  • "Contract" the present deed, including its preamble and annexes, as well as any amendment, substitution, extension or renewal agreed between the Parties;
  • "Price" the unit value of a Service in euros, all taxes included;
  • "Total Price" the total amount of the cumulative Prices of the Services covered by the Order, inclusive of all taxes;
  • "Service" any service offered for sale by the Seller;
  • "Site" online sales site used by the Seller to market its services;
  • "Order Validation has the meaning given to it in Article 6;
  • "Online Sales marketing of the Vendor's Services via the Site.

References to Articles are references to the Articles of this Agreement, unless otherwise provided.

Any reference to the singular includes the plural and vice versa. Any reference to one gender includes the other.

  1. Object

The purpose of this contract is to define the rights and obligations of the Parties with regard to the Services offered by the Vendor to the Customer.

  1. Scope of application

These General Terms and Conditions of Sale apply exclusively to consumers, as defined by law and jurisprudence, acting on their own behalf. In accordance with current legislation, the essential characteristics and prices of the Services offered are available on the Slow Village websites or displayed at the entrance to the Villages. This information is also available to any Customer on request.

These General Terms and Conditions of Sale apply to all sales of Services made through the Slow Village websites.

  1. Rental

All Slow Village rental accommodation is fully equipped and includes the number of people (including babies) specified at the time of booking, up to the maximum capacity specified for each type of accommodation. 

All accommodation is non-smoking. 

Housing capacity

Each unit is designed to accommodate a specific number of occupants, including children and babies. Under no circumstances may an accommodation be occupied by more than its maximum capacity. In such a case, the village management reserves the right to refuse access to additional guests. 

Minors not accompanied by their parents or legal guardians are not admitted to Slow Village establishments.

Housing features

The plans and photos of the accommodations presented on the website are provided for illustrative purposes only and have no contractual value. Room layouts and features may vary from one model to another. We advise you to refer to the written description of each accommodation, available on its file, for precise information on the composition and specific equipment of each accommodation.

  1. Reservations and payments

Ordering Services and completing the online sales process

To place an Order online, the Customer must complete the following steps:

  1. Go to the desired village website ;
  2. Follow the instructions, in particular those relating to the creation of a customer account;
  3. Complete the order form. In the event of prolonged inactivity, the selected Services may be lost and the Customer will have to restart his selection;
  4. Check and, if necessary, correct the elements of the Order;
  5. Confirm Order and Total Price (the "Order Confirmation")
  6. Follow the online payment instructions to complete the transaction.

A confirmation of payment is sent electronically to the Customer immediately after validation.

Unbeatable offer

The Unbeatable Offer requires payment of 100% of the Total Price at the time of booking. This offer does not allow cancellations or refunds for any reason. Customers must therefore be certain of their dates of stay before confirming their reservation under this offer.

Flexible offer

For the Flexible Offer, the Customer is required to pay a deposit of 30% of the Total Price of the rental and any additional services at the time of booking. The balance will be debited automatically 21 days before arrival. No refunds will be made for late arrivals or early departures.

Group bookings

Any booking of more than four accommodations, made by the same person or by people who know each other and are traveling together on the same dates, is considered a group booking. The accommodation offered on our sites is intended for individual customers. For all group booking requests, the customer must contact the establishment directly by telephone or email. The establishment reserves the right to refuse or accept the request after due consideration.

Terms and conditions of payment

Reservations can be paid for by various methods: bank cheque (issued by a French bank), credit card, bank transfer, vacation vouchers or connect vacation vouchers. Payment by credit card is irrevocable, except in the case of fraudulent use. Reservations are considered confirmed only after receipt of payment. In the event of non-compliance with payment conditions, the reservation may be cancelled by the Vendor. To guarantee a reservation, the customer's bank details may be required, and proof of identity may be requested for fraud prevention purposes.

  1. Prices / Rates

Accommodation prices are published on the Vendor's website and may be changed at any time without notice. Only the price indicated in the written booking confirmation is contractual. Prices include VAT in force at the time of booking. Any change in the VAT rate applicable between the date of booking and the date of payment of the balance will automatically be reflected in the amount invoiced.

Accommodations include kitchen equipment, tableware and basic bedding. Sheets and towels are either optional or included in certain accommodation ranges (please refer to the written description of the accommodation). Electricity and water are included in the price.

The amount of the tourist tax, determined by the local authorities, is payable directly to the establishment. In the case of online payment, this tax may be included in the total amount invoiced.

The Seller applies dynamic pricing, which means that prices may vary throughout the season, both upwards and downwards, depending on demand. Advantages linked to promotions or partnerships cannot be applied retroactively to a reservation that has already been partially or fully paid for.

  1. Modification, interruption and cancellation of stay

At the time of booking, you can choose between different price groups, which offer specific conditions for modifying or cancelling your stay.

Changing your reservation

  • IMBATTABLE offer:
    If you have subscribed to the IMBATTABLE offer, the reservation cannot be modified after validation.
  • FLEXIBLE offer:
    If you have subscribed to the FLEXIBLE offer, you can modify your stay according to the following conditions:

    • Up to 21 days before arrival, changes are free of charge, provided that the stay takes place in the same season and within the same establishment.
    • Any postponement or change of dates is subject to availability and the current price list. Any price difference between the old and the new stay will be charged to the customer. No compensation will be made if the new stay is less expensive.
    • From 20 days before arrival, and once the stay has begun, no changes will be accepted.
    • An increase in the length of stay is possible, subject to availability and current rates. Any reduction in length is considered a partial cancellation, subject to the cancellation policy.

All requests for modifications must be addressed directly to the establishment concerned.

Cancelling your reservation

  • IMBATTABLE offer:
    If you have subscribed to the IMBATTABLE offer, the reservation cannot be cancelled after validation.
  • FLEXIBLE offer:
    Up to 21 days before arrival, cancellation is possible, but the 30% of the stay paid at the time of booking will not be refunded, serving as a cancellation fee.
    From 20 days before arrival, or once the stay has begun, no refund will be made.

Cancellation times are calculated from the date of receipt of the request by e-mail or post.

Our establishments do not offer cancellation insurance.

Cancellation by the establishment

In the event of cancellation by the establishment (except in cases of force majeure), the service will be reimbursed within 60 days by bank transfer. Cancellation does not entitle the customer to claim damages. However, where permitted by law, the establishment may offer a credit note in lieu of reimbursement.

Unused benefits

No reimbursement will be made for any stay cancelled, interrupted or shortened by you (late arrival or early departure).

  1. The stay

Arrivals
Arrival for rental accommodation is from 4:00 pm. Any dissatisfaction with the general condition or cleanliness of the rental must be reported within 24 hours of arrival, after which time no claims will be accepted.

During your stay
It is the tenant's responsibility to ensure the supervision of their personal belongings, such as bicycles, and to comply with the provisions of the house rules. Any breach of the rules, particularly by minors unaccompanied by legal representatives or noise nuisance, may result in sanctions up to and including eviction. The right to use the barbecues on each site. All guests are responsible for any persons staying with or visiting them, and must be able to produce a certificate of civil liability insurance on request.

Departure
On the day of departure indicated on the contract, accommodation must be vacated by 10:00 am.

  • With cleaning package:
    If you have subscribed to the "housekeeping package" or it is included in your booking, you must still leave the accommodation in good general order. This includes cleaning and tidying up dishes, emptying garbage cans and stacking sheets and towels in each room.
  • Without the cleaning package:
    If you have not subscribed to the "cleaning package" service, you are required to return the accommodation fully cleaned and tidy. If this is not the case, the Vendor may charge an additional fee corresponding to the amount of the "cleaning package" to cover cleaning costs.

Any rental not vacated by 10:00 a.m. will result in the invoicing of an additional day at the current rate.

Pets
Pets are accepted in our establishments under certain conditions. They must be kept on a leash and have up-to-date vaccinations, including rabies, with presentation of the vaccination booklet. Pets are allowed in accommodations at an additional cost. 1st and 2nd category dogs are prohibited. Specific rules for animals vary from establishment to establishment, so we recommend that you contact each site directly for information.

  1. Border crossing formalities

For stays abroad, each customer must have a valid identity card, passport and/or visa, depending on the destination. We therefore advise you to check the validity of these documents for all travelers, as well as your insurance, before you leave.

  1. Intellectual property rights

The Vendor's trademark, Slow Village, as well as all trademarks, whether figurative or not, and more generally all other trademarks, illustrations, images and logos appearing on the goods, their accessories and packaging, whether registered or not, remain the exclusive property of the Vendor. Any total or partial reproduction, modification or use of these trademarks, illustrations, images and logos, for any reason and on any medium whatsoever, without the express prior consent of the Vendor, is strictly forbidden. The same applies to any combination or conjunction with any other trademark, symbol, logotype or any other distinctive sign intended to form a composite logo. In addition, all copyrights, designs, models and patents are the property of the Seller.

The Customer expressly authorizes the Vendor, Slow Village and any person appointed by the Vendor, free of charge, to photograph, film or record the Customer during his/her stay in Slow Village establishments and to use these images, sounds and videos in any medium (in particular the Vendor's websites, brochures, Facebook, Instagram, sales presentation materials and tourist guides). This authorization also extends to persons staying with the Customer. Its sole purpose is to promote the group's establishments nationally and internationally, and it may under no circumstances damage the Customer's reputation. This authorization is granted for a period of 5 years, free of charge and for all countries.

  1. Data confidentiality

In accordance with the French Data Protection Act of January 6, 1978, as amended, and with European Regulation 2016/679/EU, the Seller, Slow Village, processes Customers' personal data solely to respond to their requests, manage their user account, or for statistical purposes. Certain information is mandatory to ensure the smooth running of services.

Data is kept for as long as necessary for the performance of services or as required by law. During this period, the Vendor takes all necessary measures to guarantee the confidentiality and security of the data. Access is limited to authorized personnel and subcontractors who are bound by confidentiality obligations.

The Seller does not share data with third parties without prior consent, except for legal reasons (legal obligations, fight against fraud, etc.).

Customers have the right to access, rectify, delete and port their data. They may exercise these rights by writing to SAS Slow Village - 19 Boulevard Carnot - 49100 Angers.

For any complaint, the Customer may contact the CNIL (www.cnil.fr).

  1. Liability

Slow Village cannot be held responsible for photographs or information (false, misleading or erroneous) provided by its partners or any third party, particularly concerning visual presentations, descriptions, activities, services or operating dates published in their catalogs or on their websites.

Slow Village also declines all responsibility in the event of theft, fire, bad weather, damage to property or vehicles, as well as in the event of accidents for which the customer or another customer is liable.

  1. Dispute

Under article L. 612-1 of the French Consumer Code, any consumer has the right to have recourse, free of charge, to a consumer mediator for the amicable resolution of a dispute with a professional. The disputes concerned are those of a contractual nature, relating to the performance of a contract of sale or supply of services, and may include both national and cross-border disputes.

  1. Contact Slow Village

If, despite our best efforts to satisfy you, you have a complaint during your stay, we invite you to immediately inform the management of the establishment concerned, who will do their utmost to find a solution. 

  1. Use of a mediator

If the dispute persists, you can refer the matter to a consumer mediator within a maximum of one year of your initial request. The competent mediator is :

In accordance with article R. 631-3 of the French Consumer Code, if mediation fails, the consumer may bring the dispute before one of the courts having territorial jurisdiction under the French Code of Civil Procedure, i.e. the court for the place where the consumer lived when the contract was concluded or when the harmful event occurred.

  1. Force Majeure

Performance of Slow Village's obligations will be suspended in the event of a force majeure event preventing or delaying performance. Slow Village will inform the Customer of the situation within 2 days of the occurrence of the event.

If this suspension lasts longer than half the duration of the stay, the Customer may cancel the current reservation. The amount paid for the reservation will then be refunded as soon as possible, subject to current legislation.

  1. Independence of the parties

Neither party may make any commitment in the name of and/or on behalf of the other party. Furthermore, each of the Parties remains solely responsible for its allegations, commitments, services, products and personnel.

  1. No waiver

The fact that one of the Parties does not avail itself of a commitment by the other Party to any of the obligations referred to herein shall not be interpreted for the future as a waiver of the obligation in question.

  1. Notifications

All notices to be given under this Contract shall be deemed to have been given if sent by registered letter with acknowledgement of receipt to the following address:

  1. Applicable law

This Contract is governed by French law.
